    How to Get Collection Agencies Off Your Back

    Stay in Control
    The first thing a collection agent will try to do is take control of the situation. There's several reasons for using this tactic. The collector wants to wear you down emotionally & mentally, causing you to worry about your situation but, more importantly, they want you to agree to payments & contracts that you don't have to agree to or you are unable to pay.

    In order to maintain control, specify how much you can pay & when(if you actually owe anything) & don't let them talk you into paying earlier or more than you actually can. Never let them effect you emotionally, these people are TRYING to wear you down and, if you let them, they will succeed.

    Know your Rights
    Collectors are thieves & harassment plain & simple. You can put these people in their place per Federal Trade L*** by sending them a cease & desist letter. If they do not cease contacting you, you can immediately file a complaint with the Federal Trade Commissions.

    Here's a sample Cease & Desist Letter:


    Dear (Insert Collection Agency Here)\,

    You are hereby notified under provisions of Public L*** 104-208, also known as the Fair Debt Collection Practices Act, that your services are no longer appreciated.

    You and your organization must cease & desist all attempts to collect the above debt. Failure to comply with this law will result in my immediately filing a complaint with the Federal Trade Commission and the (home state) Attorney General's office. I will pursue all criminal and civil claims against you and your company.


    Let this letter also serve as your warning that I may utilize telephone recording devices in order to document any telephone conversations that we may have in the future.

    Furthermore, if any negative information is placed on my credit bureau reports by your agency after receipt of this notice, this will cause me to file suit against you and your organization, both personally and corporately, to seek any and all legal remedies available to me by law.
